Did You Hear About the Jerk Who Sent a Bill to His Date?

Did you hear about the jerk who sent a bill to his date for her 1/2 of the dinner tab because she wasn’t into him (or rather didn’t want him to be into her)?

According to the Daily Mail, Amanda Burnett, 23, went on a dinner date with a guy to a restaurant called The Tap in Indianapolis. After the date she realized she wasn’t interested in continuing the relationship so she decided to stop answering his annoying texts. A few weeks later, the jerk sent Amanda an invoice detailing everything she had to eat and drink that night, demanded she pay for it and threatening her that if she didn’t he would turn the unpaid bill over to a collections agency. So she posted the invoice to Twitter.”

So what she didn’t text him back? You’d think that would be a hint she felt she wasted her time that evening. She didn’t send him a bill for the time she lost.

He even had the nerve to threaten her, saying if she didn’t pay he’d send it to collections.

Of course, she may end up the big winner if he does that. If he can’t show there was a contractual obligation for her to pay, it would be ILLEGAL to subject her to collection attempts.

The Fair Debt Collection Practices Act (FDCPA)
as amended by Public Law 111-203, title X, 124 Stat. 2092 (2010)
makes it ILLEGAL for a debt collector to:

* give false credit information about you to anyone, including a credit reporting company
* harass, oppress, or abuse you or any third parties they contact.
* misrepresent the amount you owe

And that’s just some of it.

If the jerk acts as a debt collector or has a debt collector attempt to collect on the alleged debt, it could end up costing him or the debt collection agency big time:

§ 813. Civil liability
(a) Amount of damages
Except as otherwise provided by this section, any debt collector who fails to comply with any provision of this subchapter with respect to any person is liable to such person in an amount equal to the sum of —

(1) any actual damage sustained by such person as a result of such failure;

(2) (A) in the case of any action by an individual, such additional damages as the court may allow, but not exceeding $1,000

She can also sue for emotional distress for monetary damages above and beyond the $1,000.

Unbelievable! What a complete total jerk and absolute loser!
